Regulations of Henan University on disciplinary punishment of full-time ordinary college students

Chapter I General Provisions


Article 1 in order to fully implement the party's educational policy, maintain the normal teaching and living order of our university, build an excellent learning and living environment, promote the healthy growth of students, and train qualified socialist builders and reliable successors, these Regulations are formulated in accordance with the "Regulations on the administration of students in ordinary colleges and universities" and "Regulations on the administration of full-time students in ordinary colleges and universities of Henan University".


Article 2 the punishment of students' violation of discipline shall follow the principles of openness, fairness and justice, and the principle of combining education with punishment. The disciplinary punishment given to students is in accordance with the nature of students' violation of laws, regulations and discipline and the severity of their faults.


Article 3 students who violate the law, regulations or discipline shall be given critical education or the following disciplinary actions according to the circumstances:


(1) Warning;


(2) Serious warning;


(3) Recording demerit;


(4) Stay in school for inspection;


(5) Expulsion from school.


Chapter II detailed rules


Article 4 under any of the following circumstances, the student shall be expelled from school:


(1) Those who violate the constitution, oppose the four cardinal principles, undermine stability and unity, and disrupt social order;


(2) Violation of state laws, regulations and decrees constitutes a criminal offence and is sentenced to imprisonment or more by the judicial department;


(3) Those who violate the laws, regulations and decrees of the state and are sentenced by the judicial department to public surveillance, criminal detention and independent application of additional punishment;


(4) Those who violate the laws, regulations and decrees of the state and are sentenced to imprisonment or criminal detention by the judicial department with a suspension of execution or sent to reeducation through labor;


(5) Those who violate the regulations of public security administration and are punished in bad nature;


(6) Those who violate the relevant regulations on the management of student groups in our school, organize and join unauthorized groups and carry out activities, or carry out illegal activities and publish illegal publications in the name of legal groups, or have other behaviors that seriously violate the regulations on the management of student groups and cause harmful consequences;


(7) Those who repeatedly violate the school regulations and are subject to disciplinary action, but do not change after education.


Article 5 in case of any of the following circumstances, the above punishment shall be given according to the seriousness of the case:


(1) Engaging in illegal social, political, religious and other activities, organizing or participating in unauthorized processions and demonstrations in violation of the law of the people's Republic of China on processions and demonstrations or other relevant laws and regulations;


(2) Organizing or inciting disturbances, or disrupting the normal order of teaching, scientific research and life;


(3) Those who write, make, post, deliver or distribute newspapers, leaflets, slogans, etc. with illegal contents to confuse the public or create confusion;


(4) Organize and carry out unauthorized social, political and academic activities or hold unauthorized gatherings, salons, clubs, etc., and refuse to change after being dissuaded by education;


(5) Those who violate national laws and regulations and are sentenced to administrative detention;


(6) Those who violate the laws and regulations of the state and are given a public security warning or fine shall be given a warning or above.


Article 6 Anyone who snatches, extorts, steals, swindles, falsely claims or encroaches on public or private property shall be given the following sanctions in addition to returning stolen goods or compensating for losses:


(1) Those who commit crimes but have not caused economic losses shall be given a warning;


(2) If the value of the crime is less than 300 yuan, a demerit will be recorded;


(3) If the value of the crime is less than 300-800 yuan, the offender will be detained for inspection or above depending on the circumstances;


(4) Those who commit crimes worth more than 800 yuan will be expelled from school;


(5) If there are circumstances such as coercion, coercion, fraud and gang crime, the punishment will be increased by one level;


(6) Those who commit crimes more than twice in school shall be expelled from school.


Article 7 Whoever knowingly purchases stolen goods or conceals or sells stolen goods for others shall be given the following sanctions according to the circumstances:


(1) If the value of the stolen goods is less than 100 yuan, a warning will be given;


(2) If the value of the stolen goods is 100-300 yuan, a serious warning will be given;


(3) Those who buy stolen goods worth 300-500 yuan shall be punished with demerit recording;


(4) If the value of the stolen goods is more than 500 yuan, they will be detained or expelled from school.


(5) Those who shelter or sell stolen goods for others shall be punished one more level according to the above provisions.


Article 8 those who cause trouble, instigate, plan, gather together, participate in fighting, give false testimony or provide lethal weapons shall be punished as follows:


(1) Perpetrators:


1. Those who do not hit others, but cause the consequences of fighting, will be given a serious warning or demerit;


2. Those who hit others without causing injury shall be punished with demerit recording;


3. Those who hit others and cause minor injuries will be detained for observation;


4. Those who hit others and cause slight injury or more will be expelled from school.


(2) Agitators, schemers, and gatherers:


1. Those who encourage or plan others to fight and cause consequences shall be given serious warning or demerit recording;


2. Those who instigate or plan others to fight and have serious consequences will be punished by detention or expulsion.


(3) Beating others or fighting each other:


1. Those who have not been injured shall be given serious warning;


2. Those who cause minor injuries to others shall be detained for observation;


3. Those who cause minor injury to others or more shall be expelled from school;


4. Those who beat others with arms will be punished by detention or expulsion according to the degree of consequences;


5. Those who collude with people outside the school to beat people inside the school shall be punished one more level according to the above provisions.


(4) In the name of "Persuasion", those who favor one side, promote the situation to expand and cause consequences shall be given a serious warning or above.


(5) Perjury:


1. Those who witness the process of the incident but intentionally give false testimony for others or cause difficulties to the investigation shall be given a serious warning or above;


2. Those who take part in a fight and commit this crime will be given a heavier punishment.


(6) Who provided the weapon:


1. Those who do not cause consequences shall be punished by demerit recording or detention for observation;


2. Those who cause consequences will be expelled from school.


(7) Those who violate this article for more than two times and refuse to change after repeated education shall be expelled from school.


(8) Those who hurt others due to fighting must bear corresponding civil liability. Those who refuse to pay the economic loss due to their bad attitude towards admitting their mistakes will be given heavier punishment until they are expelled from school.


(9) Any injury involved in this article shall be subject to forensic examination.


Article 9 Any person who damages public or private property shall, in addition to making compensation at the original price, be fined according to the extent and circumstances of the damage, and shall be given the following sanctions:


(1) Those who intentionally damage others' property shall be given a warning or above depending on the circumstances;


(2) Those who intentionally damage campus buildings, installations, turf and other green vegetation, public facilities and public facilities shall be given a serious warning or above; those who intentionally damage campus buildings and installations with cultural relics value and memorial significance shall be given a demerit or above;


(3) Those who intentionally damage campus radio, television, telephone, network and other communication lines or equipment shall be punished with demerit recording or above;


(4) Those who intentionally damage books, library and classroom facilities, teaching instruments or equipment shall be given a warning or above;


(5) Those who violate the operation rules of experiment and practice and cause great losses to the property of the state and school shall be punished with demerit recording or above;


(6) Those who damage fire-fighting facilities shall be detained for inspection.


Article 10 those who gather people to gamble or gamble in disguised form shall be given the following sanctions depending on the circumstances:


(1) Those who take part in gambling or gambling in disguised form will be given demerit recording or detention for observation;


(2) Those who gamble for many times or in disguised form and fail to change after repeated education or collude with off campus personnel to gamble shall be expelled from school;


(3) Those who provide casinos and gambling equipment for gambling or disguised gambling but do not participate in gambling shall be punished with demerit recording; those who participate in gambling at the same time shall be punished with detention or expulsion from school;


(4) Those who violate state laws and regulations shall be handled by judicial departments.


Article 11 those who violate the relevant regulations on the management of students' accommodation shall be punished according to the circumstances as follows:


(1) Those who stay with outsiders without permission shall be given a warning; those who refuse to change after criticism and education, resulting in adverse consequences, shall be given a demerit record or above according to the seriousness of the case;


(2) Those who stay with the opposite sex in their dormitories shall be given the above punishment of staying at school for inspection;


(3) Those who pull wires and use illegal electrical appliances without correction after education shall be given warning; those who pull wires and use illegal electrical appliances, cook in dormitory, light candles and burn articles leading to fire danger shall be given demerit recording; those who cause serious damage and adverse effects of fire shall be given detention for inspection;


(4) Those who rent a house without going through the formalities for staying abroad, do not return home at night, and refuse to change after criticism and education shall be given a warning or above;


(5) Those who violate the relevant regulations of student accommodation management and refuse to change after criticism and education shall be given a warning or above depending on the seriousness of the case;


(6) The economic losses caused by the violation of regulations shall be compensated according to the price.


Article 12 the following punishments shall be given to those who commit misconduct:


(1) Those who commit fraud or defraud school scholarships, grants, subsidies for needy students, student loans or student loans shall be given a warning or above;


(2) Those who obstruct state functionaries or school administrators from performing their official duties in accordance with the law or school rules shall be given criticism and education; those who do not change after education shall be given a warning or above; those with serious circumstances and consequences shall be given a demerit record or above;


(3) Those who conceal, destroy or open other people's letters without permission, causing adverse effects or losses, in addition to compensating for economic losses, shall be given a warning or above depending on the seriousness of the case;


(4) For alcoholics, criticism and education should be given; for those who cause trouble after drinking, one level of punishment should be given according to the relevant provisions;


(5) Those who scribble, paste, hang, pour, or intentionally damage the school environment shall be given a warning or above;


(6) Those who illegally hide, sell or take psychotropic drugs prohibited by the State shall be expelled from school;


(7) Those who watch, produce or disseminate pornographic articles shall be punished with a demerit record or above; those whose circumstances and consequences are serious shall be punished with a detention for inspection or above;


(8) Those who molest, insult, slander or seriously harass others in other ways shall be punished with demerit recording or above according to the seriousness of the case;


(9) Those who force the other party to fall in love with them with a tough attitude or threat will be punished with demerit recording; those who repeatedly commit the crime will be punished with detention for observation;


(10) Those who destroy other people's marriage or family relationship shall be punished with a demerit record or above;


(11) Those involved in prostitution or whoring shall be expelled from school;


(12) Those who refuse to hand over the controlled knives shall be given a serious warning; those who cause consequences shall be given a demerit record or above;


(13) In teaching, examination, rewards and punishments, loans, employment, accommodation, campus management and other daily management, those who insult, abuse or threaten, beat or retaliate against teachers, cadres and management personnel shall be given the above punishment of staying in school for inspection.


Article 13 in case of violation of examination discipline, the following criticism, education or punishment shall be given:


(1) Generally, they violate the examination discipline and give criticism and education;


(2) In case of serious violation of examination discipline, a warning or above shall be given;


(3) Cheating in the examination room shall be punished with demerit recording or above;


(4) Those who take the examination instead of others, participate in the examination for others, organize cheating, group cheating (three or more people cheating together), using communication tools cheating and other serious cheating behaviors will be expelled from school;


(5) During the period of school, those who cheat again will be expelled from school if they are punished above demerit recording for cheating.


Article 14 in case of violation of class discipline, the following sanctions shall be imposed:


(1) Those who are absent for 10-15 class hours without reason will be given a warning;


(2) Those who are absent for 16-20 class hours without reason will be given a serious warning;


(3) Those who are absent from class for 21-30 hours without any reason will be punished with demerit recording;


(4) Those who are absent for 31-49 class hours without any reason will be given the punishment of detention;


(5) Those who are absent from classes for more than 50 hours without any reason shall be expelled from school;


(6) Those who do not participate in the collective activities organized by the school (College) without any reason (6 class hours per day) shall be dealt with according to the above provisions;


(7) In case of violating classroom discipline, interfering with teachers' lectures or affecting students' listening to lectures, a warning or serious warning shall be given according to the circumstances;


(8) Those who violate the classroom management regulations and affect other students' self-study shall be given a warning or serious warning depending on the circumstances.


Article 15 Anyone who plagiarizes or plagiarizes another person's research achievements, if the circumstances are serious, shall be expelled from school; anyone who plagiarizes or forges his homework or graduation thesis shall be punished with a demerit record or above.


Article 16 those who violate discipline on computer information network shall be punished as follows:


(1) Those who log on illegal websites or spread harmful information shall be given a serious warning or less;


(2) Those who make or spread computer virus or use network to "hack" shall be given severe warning or above; those who cause damage to network and management system shall be expelled from school.


Article 17 Whoever participates in illegal business, pyramid selling or induces others to engage in pyramid selling and refuses to change after dissuasion shall be given a severe warning or above.


Article 18 those who make rumors, frame up, threaten, slander, insult, abuse or threaten others and refuse to correct after criticism and education shall be given a warning or above; those who cause adverse consequences shall be given a demerit or above.


Article 19 those who forge, falsely claim, misappropriate, privately alter or transfer various certificates or certificates shall be given the following administrative sanctions according to the seriousness of the case:


(1) Those who lend their student cards, school badges and other certificates or certificates, or borrow others' certificates or certificates, causing adverse effects, shall be given the above punishment of warning; those who alter or forge their certificates or certificates without permission shall be given the above punishment of warning, and all consequences caused by altering, forging or lending their certificates or certificates shall be borne by the parties concerned;


(2) Those who alter their transcripts or forge other people's signatures will be punished by staying in school for inspection.


Chapter III supplementary provisions


Article 20 a student who violates discipline may be given a lighter, mitigated or exempted punishment under any of the following circumstances:


(1) Especially minor circumstances;


(2) Those who can actively admit their mistakes, truthfully account for the wrong facts, have a deep understanding of the inspection, and show repentance;


(3) Actively report and expose other people's violation of law and discipline, and assist in the organization to investigate and deal with problems, and those with a good attitude to admit their mistakes;


(4) Those who violate discipline due to coercion or deception by others and have a good attitude of admitting mistakes;


(5) Others may be given a lighter punishment according to the circumstances and consequences of the violation.


Article 21 students who violate discipline in any of the following circumstances shall be given heavier or heavier punishment:


(1) Those who deliberately conceal, refuse to admit, argue unreasonably or admit their mistakes after violating the discipline;


(2) Threatening or retaliating against the informant or witness;


(3) Those who intentionally cover up other violations of discipline, causing difficulties in investigation;


(4) Those who violate discipline outside the school or collude with people outside the school and cause bad influence in the society;


(5) Those who have been punished while in school and who violate discipline again should be punished;


(6) There are two or more kinds of violators;


(7) Violators of foreign related activities;


(8) The group of violating discipline is the leader;


(9) Those who refuse to pay compensation for losses caused by violation of discipline;


(10) Others who should be given severe punishment according to the circumstances and consequences of the violation.


Article 22 all those who are subject to administrative sanctions will be disqualified from the scholarship of this academic year and all kinds of advanced evaluation qualifications, as well as the qualification of excellent graduates.


Article 23 the period of detention for observation is generally one year. Generally, the graduating students are not given the punishment of staying in school for observation. In special circumstances, those who need to be given the punishment of staying in school for observation can be given a period reduction (at least half a year) or demerit recording. Students who have been detained for inspection shall be inspected by the college in which they work, and they have regrets during the inspection period
